The Virginia College Savings PlanSM (Virginia529SM) an independent state agency of the Commonwealth of Virginia with its principal office located at 9001 Arboretum Parkway, North Chesterfield, VA 23236 is the presenting sponsor of a gameday promotion (Sweepstakes) at a George Mason University men's basketball game in which seven (7) winners will compete for one (1) grand prize.
Seven (7) randomly selected Sweepstakes entrants will win a giveaway of two (2) tickets to the George Mason University men's basketball game against Old Dominion on December 4, 2021 at EagleBank Arena. Each winner will also receive a chance for their child, between six (6) and twelve (12) months of age, to participate in the Virginia529 Diaper Derby, a race by each child unassisted from the free throw line to mid-court at the EagleBank Arena (Contest). Each winner must arrive at the designated locations prior to the start of the contest as instructed to be eligible to participate in the contest. Winners arriving late will be disqualified at the discretion of the George Mason Athletics representative conducting the contest. The first baby to crawl to the finish line of the Contest at center court will win a contribution of $529 to a new or existing Invest529 account.
Virginia529 is an Internal Revenue Code Section 529 qualified tuition program. A Section 529 college savings account is an individual savings account intended specifically for the payment of qualified higher education expenses for a designated beneficiary. Customers are encouraged to obtain all enrollment materials, including the Program Descriptions, by calling 1-888-567-0540 or by downloading them from Virginia529.com and to read them carefully before investing. For residents of states other than Virginia: your state or the beneficiary's state of residence (if different) may sponsor a 529 plan that offers state income tax or other benefits not available to you through Virginia529.
Prizes:
Sweepstakes Prize: Seven (7) randomly selected Sweepstakes winners will win two (2) tickets each to the George Mason vs. Old Dominion basketball game on December 4, 2021 at EagleBank Arena, 4500 Patriot Circle, Fairfax, Virginia, for two (2) adults to accompany a child 6-12 months of age to participate in the Contest (collectively, the Sweepstakes Prize). No ticket is required for game entry for the child. The Sweepstakes Prize value is approximately $50.
Contest Prize: One (1) Contest winner will receive one (1) contribution of $529 to a new or existing Invest529 account depending on their success in completing the requirements of the Contest (Contest Prize). The Contest Prize value is $529 depending on the Contest participant's success in completing the requirements of the Contest. Invest529 has no state residency requirements and no age limits on beneficiaries. Invest529 is open year-round and accounts may be opened at any time.
Sweepstakes Terms & Conditions
By entering and participating in the Sweepstakes, each entrant fully and unconditionally agrees to and accepts the following Sweepstakes Terms & Conditions which are final and binding in all matters related to the Sweepstakes:
Eligibility:
1. Must be a U.S. citizen or legal U.S. resident 18 years old or older at time of entry to enter.
2. Employees of Virginia529, the George Mason University Athletic Department, George Mason Sports Properties, as well as their agents, successors and assignees, and individuals engaged in the development, production or distribution of Sweepstakes materials, their advertising and promotion agencies and any and all other persons associated with the Sweepstakes and each of their immediate family members (spouse; parents, siblings, children, grandchildren and their spouses; and in-laws) and members of the same household (whether or not related) are not eligible to participate in the Sweepstakes.
3. Entrant must be the parent or legal guardian of a baby who will be 6-12 months of age on December 4, 2021, and who consents to their child's participation in the Virginia529 Diaper Derby at the George Mason vs. Old Dominion basketball game on December 4, 2021 at EagleBank Arena, 4500 Patriot Circle, Fairfax, Virginia. Should the entrant be selected as the winner of the Sweepstakes, entrant and one other adult must accompany the child to participate in the Contest.
Timing:
1. George Mason Athletics will accept entries to participate in the Sweepstakes beginning October 1, 2021 10:00 AM ET and ending on December 1, 2021 11:59 PM ET. Entries will only be accepted between these dates and will only be accepted if they are submitted electronically by visiting www.GoMason.com. George Mason University's computer is the official timekeeping device for the Sweepstakes. Odds of winning depend on number of entries received. One (1) entry per person.
2. Winners will be selected at random from all eligible entries on or about December 1, 2021. George Mason Athletics will use its best efforts to notify the selected winners on or about December 1, 2021. Submitted entries become the property of George Mason Athletics.
Requirements of Winners:
1. Winners agree to comply with all participation requirements, including those promulgated by Virginia529 and George Mason Athletics and to complete and execute all necessary documents including, but not limited to, waivers and releases for participation in the Contest and acceptance of the Sweepstakes Prize.
2. Winners will be solely responsible for any applicable local, state and federal taxes on the Sweepstakes Prize.
3. Winners agree to George Mason Athletics' and Virginia529's use of photographs, likeness, statements, testimonials, text and/or sound or video recording of the Winner, accompanying adult and baby for advertising, promotional, or any other purposes in any medium throughout the world in perpetuity without additional compensation or consent unless required by law and to the use of the beneficiary's name for marketing and public relations purposes. Winner agrees to execute a publicity release.
4. No portion of the Sweepstakes Prize may be redeemed for cash and no exchanges or substitutions are permitted.
Other Terms:
1. In no event will Virginia529 or George Mason Athletics be responsible or liable for any damages or losses of any kind for lost, late, misdirected, incomplete, or invalid entries.
2. George Mason Athletics will be collecting personal data about entrants and will share this data with Virginia529. Virginia529 will use such data about entrants in accordance with its Privacy Policy. Virginia529's Privacy Policy is available at Virginia529.com and entrant is responsible for reviewing a copy of the Privacy Policy. By participating in the Sweepstakes and providing their email address and personal information, entrants hereby agree to George Mason University's collection and transmission to Virginia529 of their personal information, as well as Virginia529's use of their personal information. Entrants acknowledge that they have read and accepted Virginia529's Privacy Policy.
3. If, in George Mason Athletics' sole discretion, the winner is found to be ineligible to participate in the Sweepstakes or is unable to be contacted, winner will be disqualified and an alternate winner will be selected by George Mason Athletics in its sole discretion. Interpretation of and determinations on the correct application of these Sweepstakes Terms & Conditions shall be made by George Mason Athletics in its sole discretion and its decisions regarding these matters shall be final. In no event will Virginia529 or George Mason Athletics be responsible or liable for any damages or losses of any kind should winner be found ineligible.
4. By participating in the Sweepstakes, each entrant agrees to indemnify, hold harmless, and waive any claims against Virginia529, George Mason Athletics and any of their respective affiliates, employees, directors, officers, agents, representatives, and assigns, made by winners, entrants, or any other third parties arising directly or indirectly out of, or in any way connected with, this Sweepstakes or the Sweepstakes Prize awarded in connection therewith.
5. By participating in the Sweepstakes, each entrant agrees that the Sweepstakes shall be governed by, and construed in accordance with, the laws of the Commonwealth of Virginia without regard to any choice of law or conflict of law rules. Entrant agrees that venue for any litigation arising out of or related to this Sweepstakes or these Sweepstakes Terms & Conditions shall be in state court located in Chesterfield, Virginia and hereby consents to jurisdiction of same.
6. This Sweepstakes is subject to all applicable federal, state and local laws. Void where prohibited.
7. George Mason Athletics reserves the right to modify, extend, suspend, or terminate the Sweepstakes if it determines, in its sole discretion, that the Sweepstakes is technically impaired or corrupted or that fraud or technical problems, failures or malfunctions or other causes beyond George Mason Athletics' control have destroyed or severely undermined or to any degree impaired the integrity, administration, security, proper play and/or feasibility of the Sweepstakes as contemplated herein. In the event an insufficient number of eligible entries are received and/or George Mason Athletics is prevented from awarding the Sweepstakes Prize or continuing with the Sweepstakes as contemplated herein by any event beyond its control, including but not limited to fire, flood, natural or man-made epidemic of health of other means, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal state or local government law, order, or regulation, public health crisis (e.g. SARS, etc), order of any court or jurisdiction, or other cause not reasonably within George Mason Athletics' control (each a "Force Majeure" event or occurrence), then George Mason Athletics shall have the right to modify, suspend, or terminate the Sweepstakes. If the Sweepstakes is terminated before the designated end date, George Mason Athletics will (if possible) select the winner in a random drawing from all eligible, non-suspect entries received as of the date of the event giving rise to the termination. Inclusion in such drawing shall be each entrant's sole and exclusive remedy under such circumstances. Only the type and quantity of the Sweepstakes Prize described in these Sweepstakes Terms and Conditions will be awarded. George Mason Athletics has no obligation to find alternative Sweepstakes Prize winners if any of the prizes mentioned herein go unclaimed or, for any reason, are not awarded. These Sweepstakes Terms and Conditions cannot be modified or amended in any way except in a written document issued in accordance with law by a duly authorized representative of George Mason Athletics. The invalidity or unenforceability of any provision of these Sweepstakes Terms and Conditions shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Sweepstakes Terms and Conditions shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. George Mason Athletics and Virginia529 make no warranties, and hereby disclaim any and all warranties, express or implied, concerning any Sweepstakes Prize furnished in connection with the Sweepstakes.
8. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, SUCH SWEEPSTAKES PRIZE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, AND SPONSOR HEREBY DISCLAIMS ALL SUCH WARRANTIES, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND/OR NON-INFRINGEMENT.
9. ANY ATTEMPT TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, GMU WILL DISQUALIFY ANY SUCH INDIVIDUAL AND RESERVES THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS' FEES) AND OTHER REMEDIES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.

Contest Rules
By entering and participating in the Contest, each entrant fully and unconditionally agrees to the following rules related to the Contest (Contest Rules):
1. Participating babies must be 6-12 months old. Children over the age of one year old at the time of the Contest are not eligible to participate in the Contest.
2. Participating babies must be able to crawl to participate. Babies who are able to walk are not eligible to participate in the Contest.
3. Contest participants (parent or legal guardian on behalf of participating baby and accompanying adults) must complete and sign the Virginia529 Diaper Derby Contest Participant Agreement and any other required waivers or forms in order to be eligible for participation in the Contest.
4. Contest participants must comply with all rules of the Contest as stated by Contest officials, including, but not limited to:
a. Two individuals must escort and accompany the participating baby to the basketball game and will be permitted on the court at half time,
b. The two individuals escorting the participating baby may use objects (toys, keys, etc.) to encourage the baby along the Contest course,
c. Contest course will extend from the free-throw line extended towards mid-court, a distance of approximately 32 feet, and participating babies must crawl from the designated starting point to the marked finish line,
d. The first participating baby to successfully crawl the 32 feet and cross the marked finish line will be deemed the winning baby but if a participating baby walks during the course of the Contest, then that baby will be disqualified. The parent or legal guardian of the winning baby will be considered the "Contest Winner."
e. If any point a baby participant becomes uncomfortable with the situation (crying, refusal to move, etc.), then the escorting individuals may remove the baby from the race, and after removed the baby becomes ineligible to win the Contest.
5. Should no baby cross the finish line in the three (3) minutes allotted, the baby that has crawled the closest to the finish line will win the Virginia529 account.
6. Contest winner agrees to complete and execute necessary documents to open an account with Virginia529 and to provide additional documents as required by Virginia529. If Contest participant wins the Contest, he or she agrees to complete and execute necessary documents required by Virginia529 within 90 days from date of written Contest Prize notification or Contest Prize is forfeited.
7. Contest winner will be the owner of the Contest Prize and will be solely responsible for any applicable local, state and federal taxes on the Contest Prize.

If, in George Mason Athletics' sole discretion, the Contest winner or winning baby is found to be ineligible to participate in the Contest or is not in compliance with these Contest Rules, then Contest participant will be disqualified and will not be eligible to be awarded the Contest Prize. An alternate Contest participant may be selected by George Mason Athletics in its sole discretion. If, in Virginia529's sole discretion, the winner is unable to be contacted or is found ineligible to open a Virginia529 account, the winner will be disqualified and will not be awarded the Contest Prize. An alternate winner may be selected by George Mason Athletics in its sole discretion. Interpretation of and determinations on the correct application of these Contest Rules shall be made by George Mason Athletics in its sole discretion and its decisions regarding these matters shall be final. In no event will Virginia529 or George Mason Athletics be responsible or liable for any damages or losses of any kind should Contest participant be found ineligible.

11. George Mason Athletics reserves the right to modify, extend, suspend, or terminate the Contest if it determines, in its sole discretion, that the Contest cannot be conducted. In the event an insufficient number of eligible entries are received and/or George Mason Athletics is prevented from awarding the Contest Prize or continuing with the Contest as contemplated herein by any event beyond its control, including but not limited to fire, flood, natural or man-made epidemic of health of other means, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal state or local government law, order, or regulation, public health crisis (e.g. SARS, etc), order of any court or jurisdiction, or other cause not reasonably within George Mason Athletics' control (each a "Force Majeure" event or occurrence), then George Mason Athletics shall have the right to modify, suspend, or terminate the Contest. If the Contest is terminated before the designated Contest date, George Mason Athletics will (if possible) select the winner in a random drawing from all eligible Sweepstakes Winners. Inclusion in such drawing shall be each entrant's sole and exclusive remedy under such circumstances. Only the type and quantity of the Contest Prize described in these Contest Rules will be awarded. George Mason Athletics has no obligation to find alternative Contest Prize winners if any of the prizes mentioned herein go unclaimed or, for any reason, are not awarded. 13. ANY ATTEMPT TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, GMU WILL DISQUALIFY ANY SUCH INDIVIDUAL AND RESERVES THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS' FEES) AND OTHER REMEDIES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
